A convicted felon who allegedly tried to hide drugs and a gun on a fire escape as parole officers were arriving for a home visit has been arrested on new felony charges, U.S. Trini E. Ross announced.
Derrel Austin, 46, of Niagara Falls, is charged by criminal complaint with possession with intent to distribute 40 grams or more of fentanyl, and being a felon in possession of a firearm.
According to the complaint, the charges stem from a visit to Austin's home on Feb. 17, 2022, by state parole officers and Niagara Falls police.
The complaint said Austin took a long time to respond when officers knocked and was wearing a bathrobe when he finally opened the door, claiming he had been in the shower.
Officers, however, had seen Austin put several bags on a fire escape while they were waiting and recovered them during a parole search, the complaint reported.

The complaint said the bags contained suspected cocaine, fentanyl, Suboxone, a handgun and ammunition. Furthermore, the complaint noted, the shower was dry.
The complaint stated that Austin had been convicted on multiple felony charges in 1995 and 2009 in Erie County, including kidnapping and manslaughter, and is prohibited from possessing firearms.
